1. Application of Terms/Eligibility
   1. These terms and conditions (“Terms”) are applicable to and govern the Year End Loyalty Voucher Program (the “Program”). You should read these Terms carefully as they affect your legal rights and govern your relationship with us.
   2. You are only eligible to participate in this Program if you are a Loyal IQOS user, For the purpose of this Program Loyal IQOS user means: (i) you are an IQOS user aged over 18 years old and residing in Kingdom of Saudi Arabia (“KSA") and (ii) your personal details are registered in the KSA IQOS database and (iii) you have an IQOS ILUMA device of any model linked to your account in IQOS database prior to the launch date of the Program December 16th, 2024
   3. By participating in this Program, you agree to be bound by these Terms. If you do not agree or cannot comply with these Terms, then you are not permitted to participate in the Program.
2. Voucher conditions
   1. You can claim your voucher at iqos.com, through the support of the customer service center and in selected authorized IQOS selling stores in KSA. To get information about the channels where the voucher is redeemable, contact the customer service center.
   2. The Program provides 40% discount voucher redeemable only on IQOS ILUMA Prime devices (except for IQOS ILUMA Prime X Steve Aoki Limited Edition devices) applicable during the period from December 16th, 2024 to January 16th, 2025 (“Program Period”). On the last day January 16th, 2025 voucher will be deactivate in the period between 1pm to 5pm Riyadh time zone. For the authorized IQOS selling stores vouchers will be redeemable only through IQOS Brand Representative and during his/her working hours.
   3. Should you participate in the Program, you are limited to a maximum of 1 IQOS ILUMA Prime devices purchased with 40% discount voucher per device per person.
   4.  Return of a device purchased as part of the Program is governed by the terms of sale on iqos.com or of the specific store from which you purchased the device.
   5. In the event that an IQOS ILUMA Prime device purchased with the Program voucher becomes defective, the terms of the warranty shall be applicable.
   6. Buying an IQOS ILUMA Prime using the Program is subject to availability of IQOS ILUMA Prime during the Program Period.
   7. Program voucher can be combined only with Referral Program voucher that might have been provided as part of the Referral Program or any available Goodwill vouchers only through iqos.com or customer service center.  
   8. Program voucher cannot be combined with Trade-in program and/or IQOS ILUMA & TEREA Starter kit programs.
   9. We reserve the right to modify, suspend, or terminate the Program, your participation, and/or these Terms at our sole discretion at any time for any reason whatsoever.
3. Miscellaneous
   1. These Terms shall be governed by and construed in accordance with the laws of Kingdom or Saudi Arabia. You irrevocably submit to the exclusive jurisdiction of the courts of Kingdom or Saudi Arabia for disputes arising from or related to these Terms.

IQOS Spring Promotion 2025
Terms and Conditions

1. Application of Terms/Eligibility
   1. These terms and conditions (“Terms”) are applicable to and govern your participation in the Founding Day Promotion (the “Promo”). You should read these Terms carefully as they affect your legal rights and govern your relationship with us.
   2. You are only eligible to participate in this Promo if: (i) you are an IQOS user or smoker or user of other nicotine containing products aged over 18 years old and residing in Kingdom of Saudi Arabia (“KSA")
   3. By participating in this Promo, you agree to be bound by these Terms. If you do not agree or cannot comply with these Terms, then you are not permitted to participate in the Program.
2. Promo conditions
   1. The Promo is provided at iqos.com, through the support of the customer service center and in selected authorized IQOS partner stores in KSA. To get information about the channels where the Promo is available, contact the customer service center.
   2. The Promo provides 50% discount on IQOS Iluma Prime devices from March 24th, 2025 to April 17th, 2025 and in point of sales that participates in Promo. On the last day April 17th, 2025 promo will be deactivate in the period between 1pm to 5pm Riyadh time zone. For the authorized IQOS partners stores Promo will be available only through IQOS Brand Representative and during his/her working hours. The discount is not applicable to consumables (TEREA).
   3. Should you participate in the Promo, you are limited to a maximum of 5 IQOS Iluma Prime devices purchased with Promo discount per device per person.
   4. Return of a device purchased as part of the Promo is governed by the terms of sale of the specific store from which you purchased the device.
   5. In the event that an IQOS ILUMA device purchased with the Promo becomes defective, the terms of the warranty shall be applicable.
   6. Buying a device using the Promo is subject to availability of IQOS ILUMA stock.
   7. Promo offer can be combined only with Referral Program voucher that might have been provided as part of the Referral Program or any available Goodwill vouchers only through iqos.com or customer service center.  
   8. Promo offer cannot be combined with IQOS ILUMA & TEREA Starter kit programs.
   9. We reserve the right to modify, suspend, or terminate the Promo, your participation, and/or these Terms at our sole discretion at any time for any reason whatsoever.
3. Miscellaneous
   1. These Terms shall be governed by and construed in accordance with the laws of Kingdom or Saudi Arabia. You irrevocably submit to the exclusive jurisdiction of the courts of Kingdom or Saudi Arabia for disputes arising from or related to these Terms.

IQOS Retailer Get Member Program (“RGM”)
TERMS AND CONDITIONS

‘Referrer’ – A Retailer at a point of sales enrolled in RGM program

‘Referee’ – an adult (18+) user of tobacco or other nicotine containing products who has received a referral code from the Referrer.

1. The referral program is only applicable to selected Retailers who are enrolled in RGM
2. The Referrer must only share their referral code to Referees interested to switch to IQOS and residing in locations where IQOS delivery is available in Saudi Arabia, as stated on the iqos.com.
3. The Referrer must ensure they have asked for the Referee’s permission before referring them and sharing with them their unique referral code via a physical IQOS Qoin that contains the unique code of the Referrer.
4. Referral codes are individual rewards and must only be communicated to Referees on a one-to-one basis and must not be shared on large scale sharing platforms.
5. The referral code  is valid until 28 February 2025
6. When the Referee registers as a new customer on iqos.com and uses the Referrer’s unique code to purchase their first IQOS Iluma device, the referral code will give the Referee a single-use voucher of SAR 30 (inclusive of VAT) redeemable on their first IQOS Iluma device order placed on the website. If the Referee decides to purchase more than one IQOS Iluma device, within one order, the SAR 30 (inclusive of VAT) will be split proportionately amongst the devices.
7. The Referee may apply the referral code by inserting the code thereof into the field “Have a Voucher or Discount Code?”
8. The referral code is not applicable if the Referee has an IQOS devices already linked to their account.
9. The referral code may be used only once by the Referee and it cannot be used together with any other voucher or discount code . In case the order is cancelled and/or the product is returned, the referral code cannot be used again.
10. The referral code of SAR 30 (inclusive of VAT) have no cash equivalent.
11. If the Referee returns or cancels its order then the Referrer will not be entitled to any YGAG voucher for such referral.
12. The Referrer can make multiple referrals, however the referral code is only applicable for 10 successful orders during the validity of the program and provided that these terms and conditions are complied with, the Referrer will be rewarded with a maximum of SAR 1000 equivalent of YGAG voucher for ten successful referrals.
13. We reserve the right to refuse the issue of any code to a Referrer or the use of a Referrer’s code by a Referee at any time, if we reasonably believe that the Referrer or Referee is abusing this program or is otherwise in breach of these terms and conditions.
14. These Terms and Conditions may be changed and (or) supplemented by publication of the updated Terms and Conditions at the Website. The revised Terms and Conditions shall come into force and effect upon publication thereof. We reserve our right to cancel the referral code and/or YGAG vouchers without any further notice or giving reasons thereof.
15. We reserve our right to cancel the RGM Program at any moment of time without any further notice or giving reasons thereof.
16. General Terms of Sale published on the Website are applicable.

1. Application of Terms/Eligibility
   1. These terms and conditions (Terms) are applicable to and govern the provision of the post-purchase care and support services described in sections 4 - 6 below  (below (Services).. You should read these Terms carefully as they affect your legal rights and govern your relationship with Gulf Taleed Commercial Services Company, with its registered offices at P.O. Box 27801, Riyadh 11427 Kingdom of Saudi Arabia (Gulf Taleed). This Program consists of services provided to IQOS consumers as post-purchase support services described in sections 4 - 6 below (Services).
   2. You may be eligible for the Services only if: (i) you are an IQOS user aged 18 years and over and you are registered in our IQOS consumers database, and (ii) your main residence is in Saudi Arabia, (iii) you have registered an eligible device as described in paragraph 2.1 (Device) in our database either at iqos.com, by calling customer service center, at IQOS coach or at a participating IQOS store.
   3. By using any of the Services, you agree to be bound by these Terms. Likewise, if you register another Device, or if we change these Terms, and you then use any of the Services, you agree to be bound by the updated Terms. Your acceptance of these Terms is deemed to occur in the country of your registered residence as per our IQOS database.
   4. If you do not agree (or cannot comply) with these Terms, then you are not permitted to use the Services.
   5. No modification of these Terms by you is permitted unless it is expressly agreed in writing between you and Gulf Taleed.
   6. Your use of the Services is at our discretion and we may refuse your application to use, or we may terminate your right to use for any reason including if you breach any of these Terms.
   7. We also reserve the right to amend these Terms and the Services upon notice at any time.
      
2. Eligible Devices/Registration
   1. The following Device models are eligible for the Services:
      1. IQOS 3, IQOS 3 DUO, or Holders Chargers and any upgraded models thereof
      2. Any other IQOS heat-not-burn device that has been commercialized by the authorized distributor of Philip Morris International in the country of purchase and registration.
   2. The Device must have a readable and valid serial number.
   3. In completing the registration process to IQOS consumers database you must provide all required mandatory information in an accurate and complete manner and keep this information up-to-date. If you do not complete the mandatory fields in the application form (such as, for example, age, smoker status, email address and/or phone number) your application will not proceed. If you provide inaccurate or incomplete information we reserve the right to refuse to provide the Services to you.
   4. The Services provided are personal to you and may not be transferred to any third party.
   5. Your use of the Services is linked to your country of residence. As the Services are only available in certain countries if you change your country of residence, you will not be able to use the Services.
3. Term and Termination
   1. You may use the Services only within the duration of your 24 months IQOS warranty period for devices purchased in Saudi Arabia and 12 months for any devices purchased from any other IQOS commercialized market.
   2. We may refuse to provide the Services to you if you breach any of these Terms
4. Accidental Damage
   1. If your Device suffers [accidental and unintended damage] that affects the functionality of your Device which is not caused by your misuse or reckless behavior (Accidental Damage) you may be eligible for a replacement Device as described in this paragraph 4.
   2. You must give the damaged Device (including all components) to us and you will be provided with a replacement device of the same type equivalent to a new Device in performance and reliability. If a replacement Device of the same type is not available, a Device, in the same category, which is at least functionally equivalent will be provided as a replacement. We will keep all replaced Devices. If only part of the Device is damaged e.g. the IQOS 3 holder or the charger, then only the damaged part will be replaced and we will only keep the replaced part of the Device.
   3. Limitations from Accidental Damage
      1. You must take all reasonable precautions to protect your Device and use and maintain the Device in accordance with its instructions and user guide. If you do not do so then you are not entitled to a replacement Device.
      2. You are limited to one replacement Device for Accidental Damage for each registered Device.  After the first claim is settled, the Accidental Damage in your country of residence and associated Rapid Replacement on this program will cease. However, you can still receive the remaining Services for your Device until the end of your membership term (registered Device warranty period).
      3. You are not entitled to a replacement Device where the Accidental Damage was caused prior to the launch of this Service in your country of residence or where any of the following circumstances are applicable:
         1. any product that is not an eligible Device as per the list contained in paragraph 2.1;
         2. damage caused by abuse or misuse, or actual, or attempted, modification or alteration of the Device, power surge;
         3. Devices with a serial number that has been altered, defaced or removed;
         4. Devices that have been opened, serviced, modified or altered in a manner against the user guides and safety instructions of the Device.
         5. the loss or theft of your Device;
         6. cosmetic damage to your Device which does not affect the functionality of the Device, including, but not limited to, hairline cracks, scratches, dents, broken plastic on ports and discoloration;
         7. damage or failure caused by normal wear and tear and/or usage of the Device;
         8.  improper handling, or liquid contact, damage from fire, flood, or natural disaster, war, terrorism, or acts of God;
         9. malfunction due to use with non-compatible product; 
         10. damage or malfunction caused by failure to use as described in the associated IQOS User Guide; or
         11. failure due to defects in materials and/or workmanship and/or design; however, such failures may be covered separately either by your consumer rights or by the IQOS warranty that is in addition and without prejudice to all rights and remedies provided by consumer protection laws in the country of purchase.
   4. Making a claim under Accidental Damage
      1. You must:
         1. report your claims soon as possible and within the warranty period including the following information,: (1) the serial number for the affected Device; (2) description of the symptoms, problems with or causes of the damage to the Device; (3) error messages; and (4) actions taken before the Device experienced problems and any steps you took to resolve the problem;
         2. if requested, you must provide proof of purchase for your Device; and
         3. follow packaging and mailing instructions given by our agents/experts for shipping the affected Device ; and
         4. otherwise comply with our return Devices authorization process.
      2. You may also make a claim via customer service center by calling the number provided at www.iqos.com for your country of residence and providing the same information detailed in paragraph 4.4(a).
      3. You must not send products and accessories that are not supported by Accidental Damage replacement. If you send us these items they will not be returned and they will be destroyed.
      4. We will determine whether you are entitled to a replacement Device in accordance with these Terms. If you are entitled to a replacement Device this will be provided to you in one of the following ways:
         1. Courier delivery.  A replacement Device will be couriered to you and you must return the affected Device with the authorized courier as will be instructed to you by our agents.
         2. Carry-in service. You can return your affected Device to a participating IQOS store and participating IQOS service points where you will be provided with a replacement. Please check www.iqos.com for a list of stores where IQOS devices are sold/supported.
5. International Assistance
   1. You have access to an international number (charges may apply in some locations) when traveling abroad to countries where the Devices are commercialized by a Philip Morris International affiliate or an authorized partner. This service includes troubleshooting assistance from experienced Device agents and if required, replacement of your Device within (i) Accidental Damage in accordance with these Terms or (ii)  Device issues defined in terms of material or workmanship when used in accordance with the  Device User Guide. 
   2. Service options, Device availability, response, and delivery times may vary according to country.  This service will not affect your statutory rights and rights under your Device warranty valid in the country of purchase. 
   3. Limitations from International Assistance
      1. The limitations contained in paragraph 4.3 (Limitation) apply to Accidental Damage replacement under International Assistance.
      2. The following are excluded from replacement of Device issues defined in terms of material or workmanship when used in accordance with the Device User Guide:
         1. damage caused by normal wear and tear;
         2. cosmetic damage (such as scratches, dents, broken plastic etc.);
         3. damage caused by misuse, power surge, improper handling, liquid contact or fire;
         4. malfunction due to use with non-compatible product;
         5. damage or malfunction caused by attempt to open, modify and repair, either by a user or by a service provider not accredited by the manufacturer; or
         6. damage or malfunction caused by failure to use as described in the associated Device User Guide.
   4. Making a claim under International Assistance
      1. You must:
         1. report your claim to customer service center as soon as possible and no later than 1 day from the date your Device suffers Accidental Damage or  Device issues defined in terms of material or workmanship when used in accordance with the Device User Guide, including the following information: (1) the serial number for the affected Device; (2) description of the symptoms, problems with or causes of the damage to the Device; (3) error messages; and (4) actions taken before the Device experienced problems and any steps you took to resolve the problem;
         2. if requested by the entity commercializing the Device in the relevant country where the claim is raised (i.e. the Philip Morris International affiliate or the authorized partner), you must provide proof of purchase for your Device; and
         3. follow packaging and mailing instructions given by the relevant entity for shipping the affected Device; and
         4. otherwise comply with the return Devices authorization process which will be communicated to you at the time of the replacement case creation. 
      2. the entity commercializing the Device in the relevant country where the claim is raised will determine whether you are entitled to a replacement Device in accordance with these Terms. If you are entitled to a replacement Device this will be provided to you in one of the following ways:
         1. Courier delivery.  A replacement Device will be couriered to you and you must send the affected Device via the courier; or
         2. Carry-in service. You can return your affected Device to a participating IQOS store and participating IQOS service points where you will be provided with a replacement.
6. Other Services
   1. Personal Coach: A dedicated remote IQOS coach for supporting you in converting from cigarettes to a Device. Access is during normal business hours in your country of residence.
   2. Digital Welcome: Information and guidance relating to the Device usage provided in digital form to the e-mail address indicated upon registration in IQOS consumers’ database, provided that you agreed to receive commercial communication regarding IQOS via e-mail.
   3. Self Diagnostic Tool: Online tool with information designed to help you diagnose and fix certain issues with your Device or check if you are eligible for Device replacement under your warranty or Accidental Damage Coverage.
   4. Free Device Replacement Shipment: If you are eligible for a replacement device under your Device warranty or Accidental Damage Coverage service, this service provides for free shipment of your replacement device.
   5. Complete Service: A free-of-charge, professional maintenance service for IQOS™ bladed technology devices. The service includes resistance to draw machine test, professional device cleaning, firmware upgrade, and cap replacement if necessary. 
      IQOS User Content. You will receive tips & tricks to support you in converting from cigarettes to a Device. Remember to check your mailbox for this content
7. Your Obligations. 

8. You agree:

   1. 1. not to misuse the Services;
      2. to keep your membership account safe and secure;
      3. where an exchange takes place, then any replacement Device becomes your property and the replaced Device becomes the property of the entity which makes the exchange; and
      4. to comply with applicable law.
9. Warranty/Limitation of Liability
   1. As the Services are free of charge, each of them is provided ‘As Is’ and without any warranty.
   2. Gulf Taleed and/or the entity commercializing the Device in the relevant country where the claim is raised (i.e. the Philip Morris International affiliate or the authorized partner) shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your membership of IQOS Care Plus or your use of the Services. Gulf Taleed and/or the entity commercializing the Device in the relevant country where the claim is raised shall not be liable for any of the losses described in this paragraph even if you have informed such entity of the possibility of such losses.
   3. Nothing in this paragraph 8 excludes any liability that cannot be excluded by applicable law.
10. Miscellaneous
    1. None of the Services constitutes an insurance policy.
    2. The Services are currently provided free of charge.
    3. Details of the processing of your personal data that you provide us are described in our Privacy Notice available at www.iqos.com.
    4. These Terms are subject to the laws of the registered office of Gulf Taleed. Any legal dispute will be subject to the exclusive jurisdiction of the city in which Gulf Taleed has its registered office.

POST-PURCHASE DEVICE REGISTRATION
VOUCHER TERMS AND CONDITIONS

These terms and conditions (“Terms”) govern your use of the post-purchase IQOS device registration voucher code (“Voucher”)

1. The Voucher is availed upon successful self-registration of your first IQOS ILUMA device on IQOS.com through the unique QR code described in item No. 2 hereinafter.
2. The link to self-register your first IQOS ILUMA device can only be found by scanning the post-purchase QR code found at either selected IQOS points of sale or on the outer sleeve of your device (if available).
3. The reward Voucher is redeemable only on IQOS.com for future IQOS ILUMA devices purchases and/or accessories post a successful self-registration. Voucher cannot be used against the purchase of consumable i.e. TEREA.
4. You can avail the Voucher only if you are:
   1. an adult (18+) smoker or user of other nicotine containing products;
   2. residing in Kingdom of Saudi Arabia;
   3. registered an account on IQOS.com or with an IQOS Sales Expert;
   4. intended recipient of the Voucher; and
   5. self-registered your first IQOS ILUMA device using the QR code described in item No. 2.
5. Validity of the reward Voucher: 60 days from issue date, unless terminated earlier pursuant to Article 12 herein.
6. The reward Voucher can be combined only with other vouchers that may have been provided as part of the Referral Program or any available Goodwill vouchers if applicable, only on IQOS.com.
7. This Voucher will be available during the checkout page (must be logged in your IQOS.com account that was used when the QR code was scanned) to apply when needed during future purchases.
8. The Voucher is personal to you and may not be transferred to any third person.
9. The Voucher has no cash equivalent.
10. The reward Voucher may be used only once. In case the order is cancelled and/or the product is returned, the voucher code cannot be used again.
11. “Terms of Sale” published on the IQOS.com will apply to your purchase. Please read them carefully before placing an order.
12. We reserve the right to modify and/or cancel this POST-PURCHASE DEVICE REGISTRATION program in whole or in part at any time at our sole discretion without any notice. Any such modification will be effective immediately.
13. These Terms and Conditions may be changed and (or) supplemented by publication of the updated Terms and Conditions on the Website.
14. We reserve the right to change the Voucher values from time to time without any further notice.

Who are we?

• Gulf Taleed: Gulf Taleed Commercial Services Company, authorized distributor of IQOS in the Kingdom of Saudi Arabia. “We” (or “us” or “our”) refers to Gulf Taleed.

• PMI: Philip Morris International, a leading international tobacco group. It is made up of a number of companies or “affiliates”.

• PMI affiliates: Each member of the Philip Morris International group of companies is a “PMI affiliate”.

• P MI product : means a product of a PMI affiliate distributed and sold by Gulf Taleed.

How do we collect information about you?

We may collect information about you in various ways.

• You may provide us with information directly (e.g. filling in a form, or making a call to us).

• We may collect information automatically (e.g. when you use a Gulf Taleed app or website).

• We may acquire information from third parties (e.g. publicly-available information on social media platforms such as Facebook and Twitter).

In this notice, we refer to all the methods by which you are in contact with us as “ Consumer touchpoints ”. Consumer touchpoints include both physical (for example, retail outlets and events), and digital (for example, apps and websites).

We may collect information that you provide directly. Typically this will happen when you:

• sign up to be a member of our databases (this could be, for example, in person, via app, or online);

• purchase PMI products or Gulf Taleed services at a retail outlet;

• download, or use, a digital touchpoint (e.g. an app or a website);

• contact us through a touchpoint, or by e-mail, social media or telephone;

• register a device with us;

• subscribe to a Gulf Taleed panel portal (if any);

• register to receive Gulf Taleed press releases, e-mail alerts, or product communications;

• participate in Gulf Taleed surveys (where permitted by law); or

• attend an event that Gulf Taleed has organized

We may collect information about you automatically. Typically this will happen when you:

• visit an outlet that sells PMI products (e.g. by collecting your data at check-out, or through sensors at the outlet that connect with mobile technology);

• attend an event that Gulf Taleed has organized (e.g. through purchases at the event or through sensors at the event that connect with mobile technology);

• communicate with us (for example, through a touchpoint; or social media platforms);

• use Consumer touchpoints (e.g. through tracking mechanisms in an app or a website); or

• make public posts on social media platforms that we follow (for example, so that we can understand public opinion, or respond to requests concerning PMI products).

We may also collect information about you automatically through the use of cookies and similar tracking technologies on digital Consumer touchpoints. The specific cookies and technologies used will depend on the Consumer touchpoint in question. To learn about the cookies (including Google analytics cookies) and similar technologies used on a touchpoint, including how you can accept or refuse cookies, please see the cookie notice made available on or through that touchpoint.

Where permitted by law, we may acquire information about you from third parties. • Information about you may be shared with the PMI affiliate that is responsible for the country in which you live (if it wasn’t the PMI affiliate that first collected the information) for all the purposes described in this notice.

• Information about you may be shared with any other PMI affiliate that you contact (for example, if you travel and you want to know where to buy PMI products in a new country, or where to find service or support for PMI products) in order to enhance our service to you.

• To the extent permitted by applicable law, we may share information about you with third parties who provide Gulf Taleed, PMI affiliates or you with products or services (such as advisers, payment service providers, delivery providers, retailers, product coaches, information services providers and age verification providers).

• To the extent permitted by applicable law, we may share information about you with Gulf Taleed’s and/or PMI affiliates’ carefully-selected third party business partners and advertisers (in line with the kind of thing you might associate with our products, for example because they have similar or complementary image, style, or functionality) so that they can contact you with products, services and promotions that they think may interest you, in accordance with your preferences.

• We may share information about you with other third parties, where required or permitted by law, for example: regulatory authorities; government departments; in response to a request from law enforcement authorities or other government officials; when we consider disclosure to be necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity; and in the context of organizational restructuring.

1. Application of Terms/Eligibility
   1. These terms and conditions (“Terms”) are applicable to and govern your participation in the Founding Day Promotion (the “Promo”). You should read these Terms carefully as they affect your legal rights and govern your relationship with us.
   2. You are only eligible to participate in this Promo if: (i) you are an IQOS user or smoker or user of other nicotine containing products aged over 18 years old and residing in Kingdom of Saudi Arabia (“KSA")

2. Promo conditions

Terms and Conditions of the Trial Service

This service is intended for adult smokers or users of nicotine containing products aged 18 years and above. If you do not meet this requirement, you are not allowed to participate in this service.

THE TERMS AND CONDITIONS (“Terms”)

What these Terms cover. These are the Terms applicable for IQOS products which we lend to you following your interest via channels that require direct or face-to-face interaction (“F2F Channel”).

Eligibility. To be eligible to receive this service, you must be over the age of 18, a current smoker or user of nicotine containing products, you must not be going through another of our Trial Service simultaneously and you must register yourselves in our consumers database, verify your phone number using a one-time password that will be sent to you by the representative at the F2F Channel and by participating to this service, you accept to receive service related communications from us about the trial which is an integral part of your Trial Service. We shall reserve the right to object to providing you the Trial Service for any reasons.

Why you should read them. Please read these Terms carefully before you participate in the Trial Service. These Terms tell you who we are, how we will provide Products to you, how you and we may change or end the contract between you and us, what to do if there is a problem and other important information. Once you accept the Trial Service from our F2F Channels, you agree to be bound by these Terms. If you do not agree to be bound by these Terms, do not participate in the Trial Service.

We reserve the right to amend these Terms at any time. The amended Terms shall take effect on the date on which they are communicated to you via email and shall apply to all orders placed via our F2F Channels as from the date on which they are sent to you.

All participations presuppose that these Terms have been consulted and accepted by means of a checkbox provided for this purpose which includes a hypertext link to the said Terms.

C. DESCRIPTION OF PRODUCTS

There may be additional Terms you need to be aware of. Each Product made available for trial is offered subject to its Product Description which may set out additional Terms related to that Product.

D. YOUR TRIAL

When you accept the Trial Service via any of our F2F Channels, you can only try our Product for a certain period of time in accordance with these Terms.
You are required to purchase 3 different variants of TEREA but not the Lending Device. At the end of your 14 (fourteen) day trial or at any moment during your trial period, if you decide to purchase the brand new, unopened and unused version of the Lending Device, you must first return the Lending Device to the same channel where the Lending Device was handed over to you in the first place. Upon return of the Lending Device, you will be provided with a new IQOS kit and charged with the full price for the new IQOS Kit.

E. TITLE AND RISK

We shall remain the rightful owner of the Product during such trial period (including its extension if any). You will only become the owner of the Product you have ordered when it has been handed over to you and we have received clear funds in full payment for the Product. You will be held at your own risk and you will be responsible for the Product once it has been handed over to you until the moment we have in our possession the return of the particular Product we lend to you in accordance with the timeline set out under these Terms.

F. RETURNS AND REFUNDS

You must return the Lending Device to the same channel where the device was handed over to you in the first place. You cannot return any TEREA that you purchased with your Product at the end of your trial and the TEREA are non-refundable. You should ensure you return all items included in your trial kit. The return of the lent Product which you have used (either prior to or at the end of the trial period) closes the Trial Service and you will not be subject to any further fees. You must return the same products as handed over to you at the time of start of the trial.

G. CUSTOMER CARE AND COMMUNICATION.

As part of the Trial Service, one of our representatives will contact you at various points during your trial via email, SMS or telephone to provide you with the support you need to get started, and to see how you are getting along. If you have opted-out of receiving marketing communications, you will still receive our Customer Care communications, but we will not send you any marketing communications. If you opt-in to receive marketing communications from us, we do not share your details with any third-party marketers. You may opt-out of receiving any future marketing communications from us at any time by following the unsubscribe link provided in each email we send to you.

By accepting these Terms, you provide us with consent to share your personal information including name, surname, email address and telephone/mobile number with our trusted business partners. We will only provide them with personal data necessary for them to process so that they can fulfil their task which is to support us in sending SMS and email messages to you throughout your trial period of the Product.

H. ORDERS AND REFUSAL

Products availability. Product offers are valid within the limits of available stocks at F2F Channels. The Trial Service is concluded subject to the actual availability of the Products.
Trial Service from outside of the Kingdom of Saudi Arabia. We only offer the service to customers in the Kingdom of Saudi Arabia. Our F2F Channels are only able to offer the Trial Service in the Kingdom of Saudi Arabia. We do not accept orders from any consumers residing outside the Kingdom of Saudi Arabia.
How you can request the Trial Service. You can request the Trial Service at selected F2F channel locations. In order to comply with the law, we are required to verify that you are of the legal age of 18 or over before we can offer you the Trial Service.


When can you request the Trial Service with us. You can visit any of the F2F Channels during their operational hours as given here.

I. FAULTY PRODUCTS

If you believe that your Products are faulty please contact our Customer Care team or visit our store. We will perform a diagnostic with you over the phone or in person to identify the fault and if necessary, we will provide another Trial Service.

We shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your enrolment in the Trial Service. We shall not be liable for any of the losses described in this paragraph even if you have informed us of the possibility of such losses. Nothing in this paragraph excludes any liability that cannot be excluded by applicable law.

We use reasonable endeavours to verify the accuracy of any information we place on the Website and any of F2F Channels. However, we make no warranties, whether express or implied in relation to its accuracy. The information placed on the Website and any of F2F Channels is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, any of F2F Channels, or any transaction that may be conducted on or through the Website or any of F2F Channels, including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Terms for: any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Terms.

Once Products have been handed over, we accept no responsibility in the event of theft or misuse of the Products. It is your responsibility to ensure that the Products are used only by you.

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of any order you place and any related payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website or any of our F2F Channels.

M. SEVERANCE

If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and shall not affect the validity and enforceability of any of the remaining provisions of the Terms.

N. WAIVER

No waiver by us shall be construed as a waiver of any prior or following breach of any provision of these Terms.

O. SURVIVAL

Each provision of the Terms shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

P. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us with respect to the subject matter hereof and supersedes all other prior agreements and understandings, both written and oral, between you and us with respect to the subject matter hereof. These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. You irrevocably submit to the exclusive jurisdiction of the courts of the Kingdom of Saudi Arabia for disputes arising from or related to these Terms.
